INVESTIGATION ON PROFESSIONALS’ OPINION ON PAYMENT CERTIFICATE ISSUANCE CASE STUDY: NAIROBI CITY COUNTY, KENYA

ABSTRACT
The aim of the study was to find out the professionals opinion on issuance of payment
certificates in the Kenyan construction industry. It invovled analysis of the payment provision
of various standard forms of contracts that are majorly used in the country and oustide the
country. The aim of this was to show how each standard form of contract is unique in respect to
they way they issue their payment certificates and the difference invovled in their issuance.
The study relied on the responses from questionnaires that were administered to the
professionals to achieve the objectives that were set for the study. These ojectives were to
investigate the professionals’ opinion on the issuance of payment certificate in Kenya, to
establish if there is bias towards some standard forms of contract in accordance to payment
procedure and to establish where practicing professionals usually change in standard forms
contracts for effective and efficient issuance of payment certificates.
The research findings noted that most of the professionals believed that the payment certificates
were correctly issued under the contracts and although this is the case, most of them found the
need to change certain provisions of the contract to ensure payment is done effectively and
efficiently. From the study, it was established that professionals preferred most contracts
because of their familiarity in the contracts. Moreover, it was found out that they also preffered
these contracts due to their payment procedure.
The study concludes that although payment provision may differ in different contracts the
professionals should have adequate knowlegde of payment provisions and other terms of the
contract to ensure timely, effective and efficient payment. With correct issuance of payments
certificates the study deduce that matters relating to conflicts due to delayed payments will be
minimised.
